1. Introduction
These Terms & Conditions ("Terms") govern your use of the Food Park website and your purchase of vegetables and fruits from Food Park, whether at retail or wholesale rates, for delivery or in-store pickup. By browsing this website or placing an order, you agree to these Terms. Food Park is owned and operated by Ramesh Lalsingh Tiruva, trading as "Food Park", with its shop located in Kalyan, Thane, Maharashtra.
2. Use of This Website
This website is provided to help you browse our produce, compare retail and wholesale pricing, and place orders online. You agree to use it only for lawful purposes and to provide accurate information — including your name, phone number and delivery address — when placing an order.
- You must be at least 18 years old, or place orders with the involvement of a parent or guardian, to transact on this website.
- You are responsible for keeping any account or order details you share with us accurate and up to date.
- We may refuse or cancel an order where information provided appears incomplete, incorrect, or fraudulent.
3. Products, Availability & Pricing
Vegetables and fruits are agricultural produce and their appearance, size and exact weight can vary naturally from batch to batch. Product photographs are representative and may differ slightly from the item you receive. Prices shown are per kilogram unless stated otherwise, are inclusive of applicable taxes, and may change day to day based on mandi (wholesale market) rates without prior notice. Availability of any item is subject to daily sourcing and may run out during the day.
4. Retail Orders
Retail pricing applies to everyday household quantities and carries no minimum order value, although orders below ₹500 attract a flat delivery charge as shown at checkout. Retail orders are typically fulfilled the same day or the next morning, depending on the time the order is placed.
5. Wholesale Orders
Wholesale pricing applies once an order for a given item reaches that item's published minimum quantity, as shown on the Shop page. Wholesale customers — including shops, hotels, restaurants and caterers — are encouraged to register with us by phone so we can confirm a regular delivery slot, rate card and billing cycle. Wholesale rates and minimum quantities may be revised periodically based on mandi conditions.
6. Payment Terms
We accept cash on delivery and UPI for retail orders. Wholesale customers may additionally pay by weekly or monthly bank transfer as agreed at the time of registration. Full payment is due at the time of delivery unless a separate billing arrangement has been agreed in writing (including over WhatsApp) with Food Park.
7. Delivery
We currently deliver across Kalyan and nearby areas of Thane district. Estimated delivery windows are provided at checkout or confirmed by phone but are not guaranteed to the minute, as they depend on traffic, weather and daily order volume. Someone should be available at the delivery address during the agreed window; if delivery cannot be completed after reasonable attempts, the order may be rescheduled or, for perishable reasons, cancelled with a partial or full refund at our discretion.
8. Cancellations, Returns & Replacements
Because our products are fresh produce, we are unable to accept returns once an order has been delivered and accepted. However, if any item arrives visibly damaged, spoiled, or materially different from what was ordered, please contact us within a few hours of delivery, ideally with a photograph, and we will replace the item or adjust your bill. Orders may be cancelled free of charge before they are dispatched; once out for delivery, cancellations are handled case by case.
9. Limitation of Liability
Food Park takes reasonable care in sourcing, sorting and delivering produce, but we do not guarantee that every item will be entirely free of natural variation. To the extent permitted by law, our liability for any claim relating to an order is limited to the value of that order. We are not responsible for delays or failures caused by circumstances beyond our reasonable control, such as extreme weather, transport disruption, or market shortages.
10. Intellectual Property
The Food Park name, logo, and the design and content of this website belong to Food Park and may not be copied or reused without our written permission, except as necessary to place an order.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, pricing practices, or applicable law. The "Last updated" date at the top of this page shows when the Terms were last revised. Continued use of the website after an update means you accept the revised Terms.
12. Governing Law
These Terms are governed by the laws of India, and any disputes will be subject to the jurisdiction of the courts in Thane, Maharashtra.
